  1. Acceptance of Terms
    By using the "Funank" app, you agree to abide by all terms and conditions outlined here. If you do not agree to any of these terms, you may not use the app.
  2. Eligibility
    1. Users must be 18 years or older.
    2. For users under 18, parental or legal guardian consent is required.
  3. Modification of Terms
    We reserve the right to modify these terms at any time. Users will be notified of changes via the app, and continued use implies acceptance of the updated terms.
  4. Use of Content and Services
    1. The app may be used for personal and recreational purposes only.
    2. Copying or commercial use of the content is prohibited without authorization.
  5. Content Provided by Artists
    1. Artists grant us a non-exclusive, irrevocable license to use their content (images, videos, recordings) for advertising and marketing across platforms, including social media.
    2. We reserve the right to modify the content to fit our promotional campaigns.
  6. Payments and Subscriptions
    1. Subscription fees and service charges are applied as displayed in the app.
    2. All payments are non-refundable except as required by local laws.
  7. Monitoring of Conversations and Content
    1. We reserve the right to monitor conversations to ensure compliance with our policies.
    2. Conversations may be used for internal analysis or service improvements.
  8. Intellectual Property
    1. All content and trademarks belong to "Funank" or its licensors.
    2. Reproduction or distribution of any content without prior authorization is prohibited.
  9. Advertising and Promotion
    We reserve the right to use artist and user data in advertisements and marketing campaigns.
  10. Account Termination
    Accounts may be suspended or terminated in case of a breach of these terms.
  11. Governing Law and Dispute Resolution
    These terms are governed by the laws of the country in which we operate, and disputes shall be resolved in the competent courts.
  12. Cancellation and Refund Policy

    13. For Clients

    • Order Cancellation by Client:
      • If the client cancels the order, the payment is non-refundable unless the artist agrees to a full or partial refund. Funank commission will be deducted (10%).
    • Rescheduling:
      • Appointment changes are only allowed with the artist’s approval.
    • Order Cancellation by Artist:
      • If the artist cancels, an alternative artist will be provided based on availability.
      • If the client declines the replacement or no one is available, the payment will be fully refunded.

    For Artists

    • Order Cancellation by Artist:
      • If the artist cancels the order after accepting it, both the app and the client must be informed immediately.
      • An alternative artist will be provided, or a refund will be processed based on the client’s preference.
    • Adherence to Schedule:
      • The artist must adhere to the agreed schedule with the client. Any changes require mutual agreement.
    • Artist’s Compensation after Client Cancellation:
      • If the client cancels, the payment is non-refundable unless the artist agrees to a full or partial refund.
